We, the undersigned workers of Chipotle at 501 Fashion Ave are requesting the creation and recognition of a Workplace Safety Committee at this worksite pursuant to the 2021 New York HERO Act (New York Labor Law Section 27-D), to ensure high quality health and safety standards in our store and to stop the spread of airborne infectious diseases in our workplace.

Under the HERO Act, the Workplace Safety Committee is authorized to perform the following functions, among others:

 

-Raise health and safety concerns, hazards, complaints and violations to the employer to which the employer must respond.

-Review policies adopted or reports filed related to safety and health and provide feedback.

-Participate in any site visit by any governmental entity responsible for enforcing safety and health standards unless otherwise prohibited by law.

-Hold a committee meeting up to two hours in length during work hours at our regular rate of pay at least once quarterly.

-Provide an opportunity for committee members to attend a training up to four hours long at their regular rate of pay on the role and function of worker safety committees and occupational safety and health.

 

We expect Chipotle to respect our right to form a Workplace Safety Committee, to select committee representatives of our own choosing, and to participate in committee activities, and to report any violations regarding safety and health to any state, local, or federal government entity without fear of retaliation or interference.

We work hard every day to serve our customers and to keep the company running, and in return we expect Chipotle to maintain a healthy work environment. It has become increasingly clear that without oversight from a worker-led Workplace Safety Committee in our store, we will not be able to ensure safety for ourselves or for those we go home to each and every day in the midst of a pandemic.

We expect a response to this petition regarding the formation of a Workplace Safety Committee by Friday, May 20th, 2022.
